Capitulation

On 6.12.2023, I signed a settlement at an “instruction hearing” at the Commercial Court in Aarau, in which it is stated that my lawsuit, in which I had asserted the copyrights to the name and logo “the bird’s eye jazz club”, is deemed to have been withdrawn and that the association may continue to operate the well-known jazz club with this name.

I did not do this because I now think the club is in the right with the registration of my name and trademark and the way it has treated me, or because I was made some kind offer of compensation and an agreement was reached in some way, but because unfair means were used to deprive my lawsuit of its foundation and I do not have the means to achieve anything in view of the existing overpower in this way. I would risk completely losing what little I have left in material terms after this raid.

The article by David Klein in particular provides a brief and accurate analysis of the situation. As a musician, he has known the club from the very beginning, as well as the scene and me as a musician and director of bird’s eye.
